I have applied for H1B transfer and here is my situation.
H1B expiration date with ex employer was 06/10/2010 and I transferred the H1B to a new employer on 06/01/2010 and the approval came on 08/09/2010. However the approval notice says the validity date is from 08/02/2010 to 08/01/2011. It should have been 06/11/2010 because we filed this transfer before the expiration date.
We sent an inquiry but the officer was saying the application was submitted based on new employment and not continuation of previously approved employment without change with the same employer, so we will not change our decision.
What should I do? I think I was out of status from 06/11 to 08/01. Does anyone have any information?

My brother graduated in Dec 08 and is on OPT now. He is with a consultant and he was wondering if there is any rule which states that folks on OPT should get a job in 3 months, otherwise the OPT will not be valid.
Can any one please clarify.

No. You can't do anything other than H1B job.

It is possible. There is a relatively unknown technique called TT (abbreviation for Time Travel) which is also relatively related to relativity. When applied correctly, it is more effective than PD recapturing and labor substitution. That's how I got my green. My AP was approved while my wife's it was denied with reason "there is no pending I-485". My PD is 22 Nov 05 which is not yet current so I don't understand why they denied derivative spouses petition while mine was approved. We had an interview back in January and everything went on well there. Did anyone have similar issue? What are my options? I do not want to spend money and file for motion to reopen.

One of the reason may be L1 is misused very badly by body shoppers from all over the world.. example software companies ..
In case the person dont get H1B they will apply on L1 and get the green card fast, and also some guys come here on visit visa B1 Visa.
Meanwhlle genuine people here waitng for more than 10 years under Employment Based category.

Since EB-1 does not need labor certification, the process is completely independent of EB-2. As such you cannot "port" your EB-2 application the way people transition from EB-3 to EB-2. You will have to apply directly to USCIS with evidence of your "extraordinary ability" in your field, such as honorable membership of professional bodies, research track record, letters from well-known people in your field etc. The first stepto convince USCIS about exceptional ability is very involved, but there on I-140 and I-485 should proceed far more smoothly than EB-2.

I have no US visa stamped in my passport and planning to fly Emirates to India via Dubai. I will use AP for re-entry. Do I need transit visa at Dubai like London and other European Airports? Not really. If you see the late June submitters thread, many of us who applied in the June 20th timeframe have got their receipts. It took us 5 weeks to get the receipts from the date of filing.

Hello friends,
I filed for I-485 in mid-June 2007 but never received the receipt notice
(due to the issue described in this thread: http://immigrationvoice.org/forum/showthread.php?t=11788&highlight=undeliverable).
After months of calling USCIS (probably called at least 10-15 times over past 6 months) and having the lawyer send a written letter, I still did not receive the receipt notice as the customer service reps kept telling me that USCIS doesn't send a duplicate receipt notice.
When I saw that one of my friends who had the same issue received a "Replacement Receipt Notice" after calling them numerous times, I decided to call them again. I was able to convince one of the reps to put in a service request requesting "resend whatever was returned to USCIS as undeliverable".
I finally received a letter from USCIS that they will resend the receipt notice but it has been a few weeks since then and I still have not received the promised receipt notice.
Now I need to file for EAD ASAP but it requires you to attach the receipt notice (Notice of Action I-797C or I-797??).
(lawyer didn't file for EAD with I-485 as I have H1)
So my question is:
Can I use the Biometric appointment notice (ASC Appointment Notice I-797C) instead of I-485 Receipt Notice I-797 to file EAD form I-765 as a proof that I filed I-485 ?
What are the odds that they will send my EAD application back saying that I need the actual I-485 receipt notice?
What are my options?
