My 6th year on H1 ends Dec 2007. My PERM LC is pending and the lawyer is confident I won't run into problems. My question is after 6 years on H1 can I switch to H4 since my husband is on H1? Or if 6 years max given for an H visa?
Thank you.
Thank you.

The specific areas are Electronic Medical Records. This is for my cousin who is being interviewed by the clients but do not have enough information about sponsoring H1.
Wanted to know if IT Companies can apply H1 for him as his area falls under healthcare and Information Technology

Yes, you can port your EB3 priority date to EB2, even if the sponsor is not the same.
There are many threads on the topic; you may want to read them for a quick understanding...
Hi All,
I would like to know if porting an EB3 Labor & 140 to EB2 with the priority date is possible?
I am currently on h1b, I am planning to join a new company and I qualify for EB2 category.
Is it possible to port priority date of my EB3 to EB2?? with my new employer?
Thanks.

As you can see for my profile my labor cert was filed in Dec 2002 and I am Eb3 India. So all these years I have been assuming my priority date for I485 processing as Dec 2002. But now it seems there is a problem.
There have been two I-140 filings for me - first the original one which has the correct priority date of Dec 2002. Later on the company was acquired and the new company filed a successor of interest I-140 in Aug 2007. This I-140 was approved in March 2008. I have copy of this 2nd I-140 and didn't pay attention to the priority date printed on this I-140. To my dismay the priority date mentioned on the Aug 2007 approved I-140 is Aug 2007.
I wanted to find out what was the priority date in USCIS records and I called the 1-800 number. They asked me to meet the local USCIS office so took the Infopass this morning. The local San Jose USCIS office says that they would take the Aug 2007 as the priority date :( and have told me to contact my attorney.
As you can imagine I am quite devastated. Has anybody been in the same situation where the priority date on I-140 was different from Labor filing date? How did you get it corrected.
Thanks

I do not know if this has been posted on this forum..
But some of the testimonials are interesting for Students & STEM based EB applicants..
This is from Immigration-law:
02/14/2008: House Subcommittee Hearing on Status of Visas & Policies on Foreign Students and Scholars on February 7, 2008
The House had this important hearing that can have an impact on the employment-based immigration issues relating to the STEM foreign graduates in research and higher learning institutions. It is suggested that the EB immigrants in STEM to review the testimonies of witnesses in this hearing.
Purpose and Summary of the Subject
Testimonies of Witnesses:
:: Opening Statements by Rep. Brian Baird
:: Witness Statements ::
Mr. Tony Edson
Ms. Catheryn Cotten
Dr. Harvey Fineberg
Dr. Allan E. Goodman
Under the current political environment and a long pause in the employment-based immigration legislation issues in the Hill, this is indeed an important news in that at least the Congress is giving attention to the predicament the research and higher learning institutions are facing owing to the failure of the do-nothing Congress and the Administration to act on the matter.

I always wonder these ARAVAS deserve GC?
Because where ever they will make lot of fuss there and cause so many troubles to hosting country...
Srilanka they made a beautiful country as almost ash because of their perverted intensions..And Singapore they will never go with country's best interests...and Malaysia....
And even in India see the support to LTTE (Openly)
Also all most all these ARAVAs are blue collar cheap labor, I dont know how a considerable number of Tamils getting h1b
Actually USCIS needs to think about them to avoid future problems...

...that location of the attorney does not matter, unless you need him/her to accompany you to the local USCIS office for complicated cases, or for interviews.
I live in Chicagoland but my attorney is Ron Gotcher in CA (Calabassas/LA area), and I would recommend him very highly. The main thing I liked about him was that he is very reasonable and you can phone/email him as many times as you need to without getting charged left, right, and center.
I would recommend that you pick an attorney that is competent and charges a reasonable price, and one that you're comfortable with as opposed to where they're located.

Graham: DREAM Act push damaged wider immigration reform effort
Sen. Lindsey Graham (R-S.C.) said Saturday that the failed Democratic effort to pass the DREAM Act in the lame duck session dealt a blow to future talks on a wider immigration bill.
It was an exercise to try and taint Republicans with Hispanic voters, knowing that the DREAM Act under these circumstances could never pass, Graham told reporters in the Capitol after the bill sputtered on the floor.
What they have done on the DREAM Act is hurt overall comprehensive immigration reform, he said.
The DREAM Act, which would give legal status to illegal immigrants who came to the country at a young age, lived here for at least five years, graduated from high school and attended college or served in the military, fell five votes short of the 60 needed to overcome a GOP-led filibuster 55 to 41.
Graham has worked with Sen. Chuck Schumer (D-N.Y.) in the past to try and seek a Capitol Hill compromise on a wider reform plan -- one that would blend increased enforcement and border security with a path to citizenship for undocumented immigrants, among other measures.
He said the DREAM Act effort will make it harder to bridge divides on immigration, noting the impassioned advocacy on both sides of the issue.
Our base is all riled up that this is amnesty, so you have taken a debate on immigration, one part of it, you have gotten people emotional before you can sit down and reason your way through a comprehensive bill, Graham said. Doing this vote the way they did it has hurt the ability to do comprehensive reform next year to some extent.
What Graham conveniently forgets is that he gave up on the immigration bill, because it was being taken up before the 2010 elections!

off the top of y head and based on what I've read, a D70 is well worth it, even from a D100. A D2H is now cheap too. With lots of Nikon glass the options are quite good. Even a Kodak SLR/n is a good buy.....

For all the friends at IV who have already received their EAD's and/or renewed their EAD's i wanted to ask how long does it take for a person to receive their EAD after filling their 485 provided their date is current. Is filing for EAD an additional step to filling a 485 once the date is current?
2nd scenario: If i decide to change my job and my I-140 is approved with my current employer. The new job is the same level and category as my job description on my current I-140, in a new company. Can i port my PD with the new employer without any affect of I-140 withdrawl from my old employer or will the porting need to be executed prior to my old employer pulling the I-140 petition? I have some understanding about the situation but i wanted multiple opinions just to firm my understanding. Thanks in advance and may GOD help us all through the wait period to get our destinations.

I got my Finger Printing notice today and I was comparing it with the 485 receipt. The 485 receipt had A# as A9xxxxxxx ( A with 8 digits) as the receipt number while the FP notice had A09xxxxxxx as the number.
The FP notice has a "0" after the "A" and the 485 notice does not have that 0. All the digits are the same but for the 0. Any one has it similar. do i need to worry abt it? any suggestions? You think i need to get it corrected?
-Ajaygc
485 received July 27, 07
485 Receipt date - Aug 27, 07
FP issued - Sep 18, 07
Many people including me too had same issue, don't need to worry....
