I thought this will be a useful information to everyone.

My Case,
04/18/2008 -Applied EAD online
06/19/2008 -Status changes to "Approved" but no Notice sent.
07/20/2008 -Waited for 30 Days and called USCIS to open a Service Request.
07/24/2008 - Received EAD at home.

08/26/2008 - Received the letter from USCIS saying we have sent you the card but never received back or delivered to you hence concluding it is considered lost and if you need it, Please file for EAD again.

I called USCIS, Customer server rep said take an Infopass appointment to make sure it is valid.

Took the appointment, went USCIS on 09/10/2008.
Officer takes a look and tells me "Obviuosly you have EAD in your possession and unless you made it up on a color Laser printer, It is my fault that I have provided wrong information to USCIS and not waited for 30 days as I should have and I am there to pick up a fight with USCIS,bla bla bbla"

I remained very calm knowing he does not like his job but have to do it.

He is rude and clueless at the most why I am there. My first experience with USCIS, I dont think I want to go to their office again.

Finally conclusion he tell me "Once EAD is issued it remains VALID until you notify USCIS that it is lost or stolen or tempered with, USCIS DOES NOT take any proactive actions on EADs that are issued. Hence NO action is neccessary at this time"

Moral of Story is DO NOT go to USCIS if you receive such type of letter from USCIS after opening a service request for EAD.

I wasted a good amount of time and money just to take this BS.

The text is printed on your SSN card based on your visa status at the time of application. EAD is also a temporary status, this also requires a renewal. Hence, you would not be able to "remove" the text from your SSN card until your receive the GC.

Hi, Sorry if this has been asked already.. I am on H1B and the primary applicant... Can I change my SSN to remove "Work with Authorization only" statement on SSN by using EAD?

I am planning to stay on H1B and I dont want to invalidate H1B by doing this.

IV seems to have a lot of folks here on a h1b with a non profit organization. My wife is currently doing her residency in a non profit organization on a h1b so basically she is not subject to the cap.
After she finishes, and she looks for jobs, is it possible to get a h1b transfer in a profit organization without being subject to cap? Or H1b transfer is possible only with an non profit organization.

Any inputs will be well appreciated.

hi everyone

I m an MBA(major:general mba)student in a university in texas. I have an bachelors of engineeing (electrical & electronics)from india. I have found an desi employer who is ready to train me in SAP (FICO)functional and than place me on projects to diffeent companies. Since i m graduating in august 2008 ,At first i have to work for him on OPT and than in apil 2009 my employer will sponcer my h1 visa.

Now my question is....
1) can i work in SAP FICO functional , when i m on my opt?(opt means i have to work in a job directly related to my major field of study and i guess SAP is not related to my field major field of study)

2)will i have problems getting a h1b visa? (since General MBA and SAP are completely different fields )

Any comments or suggestions will be appreciated.

I don't think that would work. Here are a couple of articles that seem to suggest that you cannot create your company on H-1B (http://www.laborimmigration.com/2008/01/starting-own-company-on-h-1b-visa/) and also that you cannot volunteer to do a job which would otherwise by a paying job (http://www.laborimmigration.com/2008/02/unpaid-volunteer-work-on-h-1b-h-4-or-f-1-visas/)

Hope that helps.

As a H1B holder, can I start a new company and volunteer for it while I am holding a full-time job for the company that sponsors me the visa? I am expecting the new company to gain a profit, of course.:)

My AP is pending and my H1 visa on passport has expired like 3 months back. I am on valid H1 status which is good for another 3 years till 2010. I have scheduled H1 stamping renewal interview in India. Can there be any problems in H1 visa stamping as my AP application (I131)is still pending?

can you reword the title? I am not sure how that title is accurate given the background of how macaca was used: Sidharth (who was born and raised in the US, but is of of Indian origin) was called Macaca by George Allen because of the color of his skin. Getting a GC or not getting a GC does not change the color of one's skin so it does not stop people from calling you a macaca...

Admins can change the title - but I guess the title does not hurt - it wakes up people to what reality they live in and pretend they don't care

The details of the plan are not yet clear. As Professor Regina Germaine of the Georgetown University Law Center observed in an email message to an Immigration Professors' Listserve, "the criteria for release has always been (since 1996) the 3 factors mentioned by John Morton - 1) ID, 2) not a danger or flight risk, and 3) credible fear. And the lack of one or more of these factors is cited when ICE refuses to release someone."

So, has Morton announced a new policy or has he simply restated the existing policy in a way which suggests release, but, in fact, will lead to continued detention of asylum seekers?


Another unanswered issue is whether the policy will be followed by ICE officers throughout the country. Professor Margaret Taylor of Wake Forest University suggests it's an open question. "Hopefully there will be 'buy in' and compliance in the field offices with this policy, but history suggests otherwise."


For now let's take the Administration at its word. But time will tell whether the draconian policy of incarcerating people who seek refuge in America has finally come to an end.

Any idea with whats going on with TSC Processing times, my PD is current Nov' 2003, however do not see any movement in the processing times, 485 applied on Aug 7, 007, any idea when they will publish the new processing times? Any way we can know where we are in the 485 proccess?

Hi Every one,

I'm on OPT right now ,i'm done with my masters in DEC 2007.

My visa Stamp in my passport was only untill april 2008(I got F1 stamped only for 24 months), now i'm on OPT extension.I applied H1B in 2008 and got RFE my employer could not answer the RFE and revoked my petition.

I did't apply in 2009 even i have chance to apply(because of the JOB fear ) i got my OPT extension approved ,my OPT extension is going to end in June 2010 , any way i will be applying H1B in 2010.

My question is if i don't get H1B in 2010 ,my plan i to take CPT and search for jobs ,does it effects my future immigration any way.

The RFE was for biographic information of the passport (basically a photo identity matching the name). It appears that my lawyer may have missed sending separate copies of it for each application (485/765/131). Anyway I sent color copies of the passport pages as well as driver license. The status for the application changed to "Response to request for evidence received on 10/09/2007 and processing resumed".

As far as your FP notices, I have read that others have been able to get the notices after calling the Service Center customer service. You might want to consider that.
